This Acceptable Use Policy ("AUP") is part of and incorporated into the Enovari Cloud Terms of Service ("ToS"). Violation of this AUP constitutes a breach of the ToS. Capitalized terms not defined here have the meanings given in the ToS.
This AUP applies to all use of the Enovari platform and its component products — Scanner, Orrery, and Tapestry — whether accessed through the web application, API, or Model Context Protocol (MCP).
1. Prohibited Content
You may not upload, store, transmit, or process any of the following through the services:
1.1 Illegal Content
- Content that violates any applicable federal, state, local, or international law or regulation.
- Child sexual abuse material (CSAM) or any content that sexually exploits or endangers minors.
- Content that facilitates terrorism, terrorist financing, or violent extremism.
- Content that constitutes or facilitates fraud, identity theft, or financial crimes.
- Stolen property, including stolen trade secrets, proprietary code, or confidential information obtained without authorization.
1.2 Harmful Content
- Content designed to harass, threaten, stalk, or intimidate any individual.
- Content that constitutes defamation, trade libel, or intentional infliction of emotional distress.
- Content that incites violence or discrimination against any individual or group.
- Malicious software, viruses, worms, trojans, or any code designed to damage, disrupt, or gain unauthorized access to computer systems.
1.3 Infringing Content
- Content that infringes any third party's copyright, trademark, patent, trade secret, or other intellectual property rights.
- Code that you do not have the right to analyze, including proprietary code from former employers, leaked source code, or code obtained in violation of any license agreement.
- Bulk reproduction of copyrighted works (e.g., storing entire books, articles, or datasets in Tapestry without authorization).

1.4 Regulated Data
The services are not designed for data subject to specific regulatory compliance requirements. You may not store or process:
- Protected health information (PHI) as defined by HIPAA/HITECH.
- Payment card data subject to PCI-DSS.
- Data subject to export controls under ITAR or EAR.
- Classified government information at any level.
- Data subject to financial regulations including SOX, GLBA, or SEC rules governing material non-public information.
- Personal data of children under 13 as governed by COPPA.
If you store regulated data in violation of these restrictions, you assume all associated risk and liability. See Section 4.2 of the Terms of Service.
2. Prohibited Activities
2.1 Attacks on the Service
You may not:
- Attempt to gain unauthorized access to any part of the services, other users' accounts or data, or any systems or networks connected to the services.
- Probe, scan, or test the vulnerability of the services or any system or network connected to the services without written authorization from Silicon Harbor.
- Interfere with or disrupt the integrity, performance, or availability of the services or the infrastructure on which they operate.
- Launch denial-of-service attacks, flood attacks, or any other attack designed to overwhelm the services.
- Exploit any vulnerability, bug, or error in the services for any purpose, including gaining unauthorized access to other users' data.
2.2 Reverse Engineering
You may not:
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, data structures, or proprietary methodologies of the services, except to the extent expressly permitted by applicable law that cannot be waived by contract.
- Attempt to reconstruct, replicate, or reverse-engineer any proprietary algorithm or methodology by systematic analysis of inputs and outputs.
- Benchmark the services against competing products for the purpose of public publication without prior written consent.
2.3 Abuse of AI Features
You may not:
- Use Tapestry to build profiles on individuals without their knowledge or consent for the purpose of surveillance, stalking, or harassment.
- Use the persona system to impersonate real individuals in a manner that constitutes fraud, defamation, or deception.
- Use the memory system to store plans for, or evidence of, illegal activity.
- Use Scanner to analyze code you do not have rights to access or analyze.
- Attempt to extract or reconstruct the system prompts, persona configurations, or internal instructions of the services.
2.4 Scraping and Automated Abuse
You may not:
- Scrape, crawl, or use automated means to extract data, analysis results, or other output from the services for the purpose of building a competing dataset or service.
- Use automated means to access the services except through our published APIs and the MCP protocol as documented.
- Exceed the usage limits of your subscription plan or use the services in a manner that places an unreasonable or disproportionate load on our infrastructure.
2.5 Commercial Restrictions
You may not:
- Sublicense, resell, or redistribute access to the services or any output of the services to third parties without prior written consent.
- Use the services to develop, train, or improve a product or service that competes with any Silicon Harbor product.
- Share account credentials or API keys with unauthorized users.
3. Content Monitoring
Silicon Harbor does not proactively monitor, review, or scan the content you store in the services. We respect your privacy and treat all user content as confidential.
However, we reserve the right to investigate and take action if:
- We receive a report or complaint from a third party regarding your content or conduct.
- We receive a valid legal process (subpoena, court order, law enforcement request).
- We have a good-faith belief that your use of the services violates this AUP, the ToS, or applicable law.
- We detect automated abuse, excessive load, or patterns consistent with an attack on the services.
Any investigation will be conducted with the minimum scope necessary to address the concern, and we will notify you of any investigation affecting your account unless prohibited by law.
4. Enforcement
4.1 Enforcement Actions
If we determine that you have violated this AUP, we may take one or more of the following actions at our sole discretion:
- Warning: We may issue a written warning identifying the violation and requiring corrective action.
- Content removal: We may remove or disable access to specific content that violates this AUP.
- Account suspension: We may temporarily suspend your access to the services pending investigation or corrective action.
- Account termination: We may permanently terminate your account for serious or repeated violations.
- Law enforcement referral: We may report violations to law enforcement authorities when we have a good-faith belief that a violation involves illegal activity.
4.2 Escalation
For most violations, we will follow a progressive enforcement approach: warning, then suspension, then termination. However, we reserve the right to immediately terminate accounts without prior warning for:
- Storage of CSAM or content that exploits minors.
- Content that facilitates terrorism or violent extremism.
- Active attacks on the services or other users.
- Any violation that creates imminent legal liability for Silicon Harbor.
4.3 Data Preservation
When we receive a valid legal request, we may preserve your account data as required by law, even if your account is terminated. We will notify you of preservation requests unless prohibited by law or court order.
4.4 Appeals
If you believe an enforcement action was taken in error, you may appeal by contacting legal@silicon-harbor.net within 30 days of the action. Include your account email, a description of the action, and the reason you believe it was in error. We will review your appeal and respond within 15 business days.
5. Reporting Violations
If you become aware of any content or conduct that violates this AUP, please report it to legal@silicon-harbor.net. Include as much detail as possible, including the nature of the violation and any relevant evidence.
6. Changes to This Policy
We may update this AUP from time to time. If we make material changes, we will notify you by email and by posting a notice on our website at least 30 days before the changes take effect. Your continued use of the services after the effective date constitutes acceptance of the updated AUP.
